Agreement

These Terms of Service ("Terms") govern your access to and use of AFKCrypto’s website, APIs, and related services (the "Services"). By using the Services, you agree to these Terms.

Eligibility & Accounts

• You must be of legal age and have authority to accept these Terms.
• You are responsible for maintaining the confidentiality of credentials and API keys.
• You are responsible for all activity under your account and keys.

Acceptable Use

• No unlawful, harmful, or abusive activity, including fraud, money laundering, or violations of sanctions.
• No interference with the Services or access using non‑public interfaces.
• No infringement of third‑party rights or attempts to bypass security or limits.

Non‑Custodial & Risks

AFKCrypto provides non‑custodial tooling and execution. You are solely responsible for your wallets, keys, smart contract interactions, and transaction decisions. Crypto asset values are volatile and transactions may be irreversible. You assume all risks related to your use of the Services.

Fees & Taxes

You are responsible for all network fees (e.g., gas) and applicable taxes related to your use of the Services. We may charge service fees as described in separate pricing or order forms.

Service Changes

We may modify, suspend, or discontinue parts of the Services at any time. We aim to provide notice of material changes when practicable.

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFKCRYPTO AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO AFKCRYPTO FOR THE SERVICES IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR USD $100, WHICHEVER IS GREATER.

Indemnification

You will defend, indemnify, and hold harmless AFKCrypto and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services or violation of these Terms.

Termination

We may suspend or terminate your access to the Services immediately for any violation of these Terms or for risk/security reasons. Upon termination, your rights under these Terms will cease.

Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law rules. Any dispute shall be resolved in the state or federal courts located in Delaware. You consent to jurisdiction and venue in those courts.

Changes to Terms

We may update these Terms from time to time. The "Last updated" date reflects the latest changes. Your continued use of the Services after changes constitutes acceptance of the updated Terms.
